Welcome to Pernox Games, a game studio operated by Mware, based in Antwerp, Belgium ("Pernox," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website at pernox.games and any of our games and applications, such as Shayp (together, the "Services"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be old enough to form a binding contract in your country to use the Services, or use them under the supervision of a parent or legal guardian who agrees to these Terms. The Services are not intended for children under 13 (or the equivalent minimum age where you live).
2. License to use our games
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use our games for your own private, non-commercial entertainment on devices you own or control. All rights not expressly granted are reserved by Pernox.
3. Things you agree not to do
- Copy, modify, reverse-engineer, decompile, or create derivative works of the Services, except where the law expressly permits;
- Cheat, use unauthorized third-party software, exploit bugs, or interfere with the normal operation of the Services or other players' experience;
- Attempt to gain unauthorized access to our systems, accounts, or networks;
- Use the Services for any unlawful purpose or in violation of any applicable law or app-store rules;
- Resell, redistribute, or commercially exploit the Services without our written permission.
4. In-app purchases & virtual items
Our games may offer optional in-app purchases and virtual items (such as removing ads, coins, or cosmetic content). All purchases are processed by the Apple App Store or Google Play and are subject to their terms. Virtual items and in-game currency have no real-world monetary value, cannot be exchanged for cash, and are licensed — not sold — to you. Except where required by law or the applicable app store's policy, purchases are non-refundable. Refund requests are handled by the app store you purchased from.
5. Advertising
Our games may display third-party advertising. We are not responsible for the content of ads or for any products or services they promote. Your interactions with advertisers are solely between you and the advertiser. See our Privacy Policy for how advertising data is handled.
6. Intellectual property
The Services — including the Pernox Games name and our game brands (such as Shayp), together with all logos, artwork, audio, code, and related content — are owned by Pernox or our licensors and are protected by intellectual-property laws. You may not use our names or logos without our prior written consent.
7. Updates & availability
We may update, change, suspend, or discontinue any part of the Services (including features and game content) at any time, with or without notice. We do not guarantee that the Services will always be available, uninterrupted, or error-free.
8. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Pernox and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Termination
We may suspend or terminate your access to the Services if you violate these Terms or misuse the Services. You may stop using the Services at any time by uninstalling the games and ceasing to use the Site.
11. Third-party platforms
Your use of the Services through Apple, Google, or other platforms is also subject to those platforms' terms. These Terms are between you and Pernox, not with Apple or Google, who are not responsible for the Services.
12. Governing law
These Terms are governed by the laws of Belgium, without regard to conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts of Belgium, unless mandatory consumer-protection law in your country of residence grants you the right to bring proceedings, or requires proceedings to be brought against you, in another jurisdiction.
13. Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the revised Terms.
